During the 2004 primary, fellow Democrat Lisa Quigley challenged Costa to take a drug test. She was referring to a 1994 incident where police investigating a burglary at Costa's home discovered a box containing marijuana under his bed. Costa denied that the pot was his, and no charges were filed.
In 1986, Costa had been arrested in Sacramento, California for solicitation of a prostitute. Reportedly, he had driven up to a police decoy and propositioned her to join in a three-way with the whore he had already picked up. Costa pled no contest to the crime. 18 years later, Quigley reminded voters of this incident through a telephone push-poll.
