On 16 July 2009, Gates was confronted by police in his home after reports that a black man -- Gates -- had broken and entered. After showing the police officer his driver's license with his address on it, Gates berated the policeman for racial profiling, and his hostile attitude prompted a disorderly conduct arrest. He could never have been convicted on the charge, as in Massachusetts disorderly conduct must occur in a public place, not a private residence.
